We have recently issued guidance in the USCIS Policy Manual to provide clarity on the participation of H-3 nonimmigrants in training programs conducted on the premises of academic or vocational institutions. In general, H-3 trainees are not permitted to engage in training offered primarily by these types of institutions. The updated guidance emphasizes that if all other H-3 visa requirements are met, training conducted on the premises of an academic or vocational institution may be acceptable if the program is primarily initiated, structured, and supported by a government agency or another non-academic entity. This clarification aims to provide further understanding of existing policy rather than introducing any new changes.
